Terms & Conditions

This website is owned and operated by Alba Mountainbike. These Terms set forth are the terms and conditions under which you may use our website and services as offered by us. This website offers visitors to mountain bike adventures and tuition experiences and courses. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

Data Protection

​

The information provided on this form will be used for the purposes of providing you/your child with coaching services throughout the year. This information will be stored, processed and destroyed in accordance with the principles of the Data Protection Act 1998.

Bike, Helmet and Clothing

​

It is the responsibility of the rider (or their parent/guardian/carer if aged under 18) to ensure that their bike, helmet and clothing is appropriate, well maintained and in a safe condition prior to participating in every session. Riders must wear a helmet which complies with current safety regulations when riding their bike.

Traffic Free Environments

​

  • Riders under the age of 12 are only permitted to participate in coaching activities in a traffic-free environment. 

  • In some instances, it may be necessary for the coach to move riders from one location to another, which may require limited use of the public highway. For example, moving from the meeting point to the coaching area, or between coaching areas. Riders under the age of 18 will be under the coach’s direct supervision throughout the route.

  • Young riders are expected to remain in the session from beginning to end. If a rider has to leave early or is being collected by someone other than the parent/guardian/carer, the coach must be informed of this arrangement, including who will be collecting the rider. 

  • All riders are expected to behave in a manner that does not impact on the fun and safety of other riders. The coach may exclude riders who persistently misbehave or put other riders in danger. 

 

 

Public Highway

​

When riding on the public highway, riders should be able to do so in a safe and competent manner. It is recommended that the rider should at least one of the following:

 

  • Previously demonstrated in a traffic-free area, the riding skills required to ride on the public highway in a safe, confident and consistent manner

  • Have substantial experience of riding on the road already

  • Have attained at least Level 2 Bikeability.

Participating in Prescribed Training

​

  • Only British Cycling Level 2 and 3 qualified coaches may prescribe training for individual riders.  

  • A coach may only prescribe training for individuals aged 14 years or older. 

  • Training prescription may include a variety of activities in a variety of environments including the public highway. These sessions may be prolonged and intense. 

  • Riders will be required to perform sessions without the supervision of a coach, so for riders under the age of 18, the parent/guardian/carer will be entirely responsible for their safety in such circumstances. 

  • For younger riders, one-to-one training should focus on learning how to train, rather than on specific performance goals. Therefore, it is recommended that only riders over the age of 16 participate in prescribed training. 

  • All riders participating in prescribed training must complete a Rider Profile form or equivalent. 

  • Riders are required to provide feedback to the coach regarding training, racing and any other factors that are likely to affect their cycling performance. This feedback is fundamental to the coaching process and the coach may cease to provide training prescription when not provided.

Who can use this website?

​

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

What is offered?

​

Alba Mountainbike offers mountain bike adventure and tuition services within Scotland. Primarily an outdoor tourism experience provider, Alba Mountainbike does not offer accommodation, cuisine or transport. If you are looking for our services outside the 50 miles radius from Fort William there will be an additional charge for travel expenses unless you have booked a tour or session that will justify the cost for us to offer said service, ask for further details.

Key commercial Terms offered to customers?

​

When booking our services, you agree that: (i) you are responsible for reading the full item listing before making a commitment to book it: (ii) you enter into a legally binding contract to purchase our services when you commit to booking a service and you complete the payment process.

The prices we charge for using our services are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on request.

Cancellation and refund policy

 

Due to the occasional harsh environments in Scotland, your guide might feel it appropriate to cancel your ride if they deem it too severe to participate, in this circumstance you will be offered a rescheduled date and if not suitable, a refund based upon the original payment method will be offered. In addition, please note the following services are not eligible for refund: Gift Vouchers, travel expenses (once embarked upon travel), Guide fees with an additional freelance instructor, accommodations previously booked, additionally organised services organised by us that are outside our normal tour or session experiences.

Retention of right to change offering#

​

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Ownership of intellectual property, copyrights and logos

​

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Alba Mountainbike. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

Right to suspend or cancel user account

​

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

Indemnification

You agree to indemnify and hold Alba Mountainbike harmless from any demands, loss, liability, claims or expenses (including lawyer fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Alba Mountainbike, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Alba Mountainbike assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our services after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Promotional emails and content

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.

Preference of law and dispute resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of Scotland, Highland, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Fort William. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
